PREAMBLE

 

           We, the NYISHI, having solemnly resolved to constitute a SOCIETY, in order to promote UNITY, INTEGRITY, FRATERNITY; and to endeavour to uplift the NYISHI: SOCIAL, TRADITION, ECONOMY, EDUCATION and LITERATURE; to create a sense of belongingness and to preserve, protect and promote the rich CULTURAL HERITAGE; to foster and exploit the talents in the greater interest of the COMMUNITY and to imbue a rational scientific temperament for all round development; do HEREBY ADOPT, ENACT and GIVE TO OURSELVES this BYE-LAW of the NYISHI ELITE SOCIETY on this twenty-fourth day of August Nineteen Hundred and Eighty Eight.

 

ARTICLE 1: TITLE AND HEADQUARTERS

The Society shall be called (titled) NYISHI ELITE SOCIETY in short abbreviated as N.E.S. The Headquarters of the Society shall be at NYIRUBJOLLI, District, Papum Pare, Arunachal Pradesh (India).

 

ARTICLE 2: FLAG/EMBLEM

The emblem of the Society shall be the MAZI encircled by a crimson circle down side written within HURABTO-GORABTO and crescent GREEN circle on the base conspicuously inscribed NYISHI ELITE SOCIETY:

i.          the MAZI is a bell shaped furnace metal which is highly valued and legendary inherited property of the Nyishi; and it symbolises dignity, pride and prosperity;

ii.         the golden light glow radiating out from behind the MAZI symbolises source of power and enlightenment;

iii.        the crimson circle represents the quest for unity and integrity; and

iv.         Crescent green circle, represent the peace, harmonious living, dedication and service towards Community.

v.          the Flag of the Society shall tri-colour with Sky Blue on the top, white in the middle with NES logo at the centre and Navy Blue in the bottom in the ratio 2:3 in size. The hoisting of the Flag shall be raised from the ground while hoisting.

 

ARTICLE 3: AIMS AND OBJECTIVES

  The aims and objectives of the Society are as under:

i.          to promote and foster fraternity and integrity, and to create a sense of belongingness among the Nyishi;

ii.         to channelise and exploit the hidden talents of the people in the greater interest of the Community;

iii.        to create awareness among the members of the Community to cope with the changing pace of development;

iv.        to prevent the people from being divided in the name of religion, region, sect, clan and creed;

v.         to encourage the establishment of qualitative educational institutions and scholarship;

vi.        to preserve and promote the rich cultural heritage and tradition of the Community;

vii.       to reform the Community to build a refined and scientific society;

viii.      to preserve and document all the orally transmitted traditions, customs, practices such as folklores, folk songs, folktales and performing arts (folkdances);

ix.        to render humanitarian services to the needy people; and

x.        to institute awards and citations in order to recognize and encourage the individual’s contribution to the upliftment of the Society.

 

ARTICLE 4: DEFINITIONS

In this Society and in all articles hereunder framed shall remain intact, any resolutions or amendments to this Bye-Law, unless the context otherwise requires:

  1.     ‘Nyishi’ means a person belonging to the Nyishi Community;
  2.     ‘Elite’ means an Elite Member of the Nyishi Community, qualifying as per Article 6 of   this Bye-Law;
  3.     ‘Society’ means Nyishi Elite Society;
  4.     ‘President’ means the President of the Society;‘Secretary’ means the Secretary of the Society ;
  5.     ‘Member’ means the registered Life and Biannual Member of the Society;
  6.     ‘Community’ means the Nyishi Community;
  7.     ‘Executive Body’ means the Office Bearers and co-opted Executive Committee Members of the Society;
  8.     ‘Office Bearers’ means all the Office Bearers elected during the General Conference of the Society, as defined in Article 9,[Clause: i to viii] of this Bye-Law;
  9.     ‘Extended Executive Body Meeting’ means the meeting hold or organize including Executive Body, Ex-Officio Members and special invitees for a specific purpose;
  10.     ‘General Body meeting’ means the meeting attended by Life Members, Biannual Members and Executive Body;
  11.     ‘Bye-Law’ means the Bye-Law of the Nyishi Elite Society;
  12.     ‘Electoral College’ means the Electoral College constituted by the Search Committee from amongst the total registered Life/Biannual Members;
  13.     ‘General Conference’ means the General Conference of the Society organized on or before the expiration of the term of an incumbent Office Bearers;
  14.     ‘Biannual Business Session’ means the Biannual Business Session held during the General Conference of the Society; and
  15.     ‘District’ means the District inhabited or dominated by the Nyishi.

 

ARTICLE 5: JURISDICTION

The Nyishi Elite Society covers all the Nyishi of Arunachal Pradesh and it also extend its jurisdiction to the Nyishi inhabiting elsewhere in the country and abroad.

 

ARTICLE 6: MEMBERSHIP:

Any bonafide Nyishi who fulfils all the following conditions shall be eligible to become a member of the Nyishi Elite Society:

i.          who attains the age of 25 years or graduates shall be eligible to apply for the registration of membership;

ii.         who accepts the aims and objectives of the Society and is genuinely interested to serve the Community;

iii.        Anyone who establishes himself/herself as distinguished person in his/her field of   profession/occupation;

iv.        whose application along with prescribed fees for the Membership has been accepted by the President.

v.         Membership shall be of two kinds:

            (a)        Life Member

            (b)        Biannual Member

vi.        Membership fees:

            (a)        Life Member               Rs. 1000.00

            (b)        Biannual Member       Rs.   200.00

vi.        Life Member is registered only once and shall remain till one’s withdraw or become dismemberment; and

Vii.      Biannual Member is to renew in every General Conference by paying the above prescribed fees.

               

ARTICLE 7: CESSATION OF MEMBERSHIP

Any registered Member shall be ceased or disqualified from the Membership of the Nyishi Elite Society on the following grounds:

i.          if one fails to conform to the requirements of this Bye-Law and if his/her conduct becomes detrimental to the aims and objectives of the Society as enumerated in Article 3;

ii.         if he/she voluntarily resign from the Society; and

iii.        if one is found to be an anti-Community.

 

ARTICLE 8: QUORUM OF THE MEETING

  1. the quorum for an Extended Executive Body Meeting(EBM) shall be the majority of not less than two-third of the members invited for the meeting, and shall be convened or organised as and when situations so warranted, thereof ;
  1. the quorum for a meeting of the Executive Body shall be one-third of the total Office Bearers. The Executive Body Meeting shall convene as and when situation so demand; and
  1. any resolutions or decisions shall be taken by the two-third majority of the members present and voting in the meeting.

 

ARTICLE 9:  EXECUTIVE BODY

                        There shall be an Executive Body to manage the affairs of the Society consisting of the following:

i.          President

ii.         Vice- President        (a) Eastern Zone                                             (b) Western Zone

iii.        General Secretary

iv.        Assistant General Secretary

v.         Secretary, Finance

vi.        Secretary, Woman Wings

vii.       Secretary, Information & Publicity

vii.       Secretary, Art & Culture

viii.      Secretary, Education & Literature

ix.        Secretary, Sports & Youth Affairs

x.         Secretaries (Each District shall be represented by one Secretary including West Kameng & Assam)

xi.        Assistant Secretary, Information & Publicity

xii.       Assistant Secretary, Art & Culture

xiii.      Assistant Secretary, Education & Literature

xiv.       Assistant Secretary, Sports & Youth Affairs

         

ARTICLE 10:  ELECTIONS

The following are the rules and procedures pertaining to elections to the various posts of the Nyishi Elite Society:

  1. an elections to fill a vacancy caused by the expiration of the term of Office  Bearers shall  be completed on or before the expiration of that term;
  2. the Office Bearers, Article 9[ Clause i to viii] shall be elected by an Electoral College at the session held during the General Conference of the Society;
  3. by convention  , there shall be no filing of nomination papers for the election of the office bearers;
  4. the incumbent Executive Body shall constitute or appoint a Search Committee to form an Electoral College from amongst the registered Members of the Society. This appointment shall have to be done at the time of the General Conference-Cum-Election;
  5. the Office Bearers of the Society shall be elected by the constituted Electoral College;
  6. the Executive Body shall ensure the free and fair elections of the incoming Office Bearers, and
  7. all elections shall be by secret ballot.

 

ARTICLE 11: QUALIFICATIONS AND DISQUALIFICATIONS

 The following are the qualification and disqualification to become an Office Bearer of the Society:

  1. an outstanding person who has done considerable contribution in preservation and upliftment, and committed to uphold the philosophy and social values of the Preamble; and also aims and objectives of the Bye-Law shall be elected by the Electoral College to the office of the Society,
  2. one must be a Nyishi and registered Life Member and he/she must not be less than 25 years of age on or before the date of election; and
  3. the statutory disqualification is the holding of an office under any National, Regional and State Political Party.

           

ARTICLE 12: THE TERM OF OFFICE

  The Office Bearers shall hold office for a term of three years from the date on which he/she elected or entered upon his/ her office, but shall be eligible for re-election:

  1. he/she shall resign his/her office by writing under his/her hand addressed to the President.
  2. However, the President shall addressed to one of the Vice Presidents of the Society;
  3. any Office Bearer may be removed from his/her office by impeachment on grounds of violation of the Bye-Law. The charge for impeachment may be preferred by a resolution signed by at least one-third of the total number of the Office Bearers and passed by a majority of not less than two-third of the total members present and voting at an Extended Executive Body Meeting [EEBM]. The Office Bearer shall stand removed from his/her office from the date of the passing of such resolution in that effect.

 

ARTICLE 13:  FUNCTIONS OF THE EXECUTIVE BODY

           The Executive Body shall have the following functions:

  1. to decide major issue of the Society and Community for the greater interest;
  2. to decide the date of holding of General Conference, General Body Meeting, Extended Executive Body Meeting and Executive Body Meeting;     
  3. to fill up any vacancy so arise in the event of resignation, cessation of membership, death, etc., of the members of the Executive Body;
  4. to receive fund, acquire and hold properties, and manage all funds raised in the name of the Society;
  5. to attend affairs of the Society and call of the Community;
  6. to act as referral body of the Nyishi Community in the field of socio-cultural and literary activities;
  7. to accept or reject the application for registering of the Membership to the     Society;
  8. consideration of the Reports prepared by the Secretary and laying it be the Biannual Business Session of the Society;
  9. consideration of the Budget prepared by the Secretary Finance in consultation with the Executive Body, and laying it before the Biannual Business Session of the Society;
  10. framing the rules of business and placing them before the Biannual Business Session of the Society for confirmation;
  11. consideration of the Resolutions proposed for the General Conference; 
  12. appointment of an Auditor(s) [Registered Chartered Accountants] for auditing the accounts of the Society; and
  13. any other issue which is of supreme interest for the entire Nyishi community.

 

ARTICLE 14:  POWERS AND FUNCTIONS OF THE OFFICE BEARERS

14. [1]: President

According to article 9, there shall be a President for the Society. Under the Bye-Law, in the discharge of all his/her functions, with a few exceptions in certain cases, the President is to be guided by the aid and advice of the Executive Body [Article 13]:

  1. the President shall be the head of the Society and all Executive Power of the Society is vested in the President and is to be exercised by him/her either directly or through Office Bearers subordinate to him/her in accordance with the Bye-Law;
  2. all the Executive Body action is to be taken in the name of the President. The President may make rules for the more convenient transaction of business of the Society and for allocation of work among the Office Bearers. A decision of the Executive Body does not become operative as a Society order unless expressed in the President’s name and duly authenticated;
  3. the President may nominate to the Executive Body of the Society from among persons having special knowledge or practical experience in respect of arts, cultural, literature, traditions and customs of the Community;
  4. the President is required to cause to be laid before the Executive Body Meeting, General Body Meeting, the General Conference, the Budget and the Annual Financial Report of the Society. An expenditure financial statements and budget has to be signed and endorsed by the President;
  5. the President shall be the Spokesperson of the Society or may appoint[nominate] a person from among the Office Bearers, if he/she feels the need of such appointment; and
  6. the financial power of the Society shall be vested with the President.
  7. to represent the Society in suits or proceedings by or against the Society and verify pleadings or dispute ;

 

14. [2]: Vice-President

As per Article 9, of the Society, there shall be the two Vice Presidents [one each from Eastern and Western Zone]. Next to the President of the Society, the highest position in the official protocol of precedence is accorded to the Vice President.  Other functions and duties of the Vice President shall be  

  1. one of the Vice President shall be nominated by the Executive Body to act as the President, in the event of a vacancy in the office of President by reason of his/her death, resignation or impeachment or otherwise;
  2. in case the President is unable to discharge his/her functions owing to absence, illness or any other cause, one of the Vice President shall discharge his/her functions, as decided by the Executive Body, therein. While acting as President or discharging the functions of President, he/she shall not perform the duties of the office of the Vice President; and
  3. he/she shall also perform such other functions as are assigned to him/her by the President from time to time.

 

 14. [3]: General Secretary

The General Secretary shall be the leader of the Executive Body of the Society. He/she shall be responsible for the executive administration of the Society subject to control of the Executive Body. The duties of the Secretary shall be:

  1. to conduct all correspondence of the Society;
  2. to make arrangements or convene the meeting of the Executive Body, the General Body, the Extended Executive Body and the General Conference in consultation with the other Office Bearers;
  3. to frame the agenda for the Meeting of the Society and to issue notices or circulars for the Meeting, thereof;
  4. to keep the minutes and proceedings of all the Meetings of the Society and meeting of any other committee(s) appointed by the Society;
  5. to be the custodian of the records, the common seal and such other properties[assets] of the Society;
  6. to ensure proper implementation and execution of resolutions passed or adopted by the General Body or the Executive Body; and
  7. when the office of the General Secretary is vacant or when the General Secretary is by reason of illness, absence or any other cause unable to perform the duties of his/he office, the duties of the office shall be performed by Assistant General Secretary as the President may appoint from amongst the Secretaries for the purpose in consultation with the Executive Body Members.

 

 14. [4]: Secretary

There shall be a number of Secretaries representing the different Nyishi inhabited district of Arunachal Pradesh and other States of the country and abroad. The Secretary shall assist the General Secretary in the performance of his/her duties along with allocated special assigned functions and duties:

i.   the Secretary-in-Charge of the different districts shall look after the affairs of its own allocated district and file report to this effect to the President and General Secretary from time to time;the Secretary-in-Charge shall discharge the duties as per the allocation of work and specialised assignments as and when entrusted by the President or the Executive Body;

  1. the Secretary, Women Welfare, shall look after the affairs of the women and give report in this respect for carrying out a suitable policy and programme.
  1. the post of Chairman and Convenor of the District shall be appointed by the President after due consultation with Secretary-in-Charge of the District.
  1. The Chairman and the convenor of the District shall constitute the other Executive members for the District unit in consultation with the Secretary-in-Charge of the Districts.

 

14. [5]:  Secretary, Finance

            The Secretary, Finance shall be the financial officer of the Society:

  1. he/she shall keep charge of all accounts of income and expenditure of the   Society.
  2. he/she shall prepare the Annual Financial Reports or [Statements] and Budget in consultation with the Secretary and lay the Chartered Accountant’s audited accounts and the Budget before the Executive Body for duly recommendation to be placed at the Annual Business Session of the Society; and

        iii.  the Society shall raised its fund from the following sources:

  1. Membership fees;
  2. donation/contributions from the well-wishers;
  3. by obtaining grants-in-aids from the govt. and any other institutions;
  4. interests from the saving accounts of the Society; and
  5. selling of the published proceedings and other publications.

 

ARTICLE 15:  EX-OFFICIO MEMBERS

The President and the General Secretary or Secretary of the following Bodies and Unions shall be the statutory Ex-Officio Members of the Nyishi Elite Society [NES]:

  1. The Chairman, Central Nyokum Committee (CNC).
  2. The Secretary, Central Nyokum Committee(CNC).
  3. The Chairman, Nyikum Nyia Welfare Society.
  4. The Secretary, Nyikum Nyia Welfare Society.
  5. The President, All Nyishi Students’ Union, (ANSU).
  6. The General Secretary, All Nyishi Students’ Union, (ANSU).
  7. The President, Nyishi Service Engineers Forum, (NSEF)
  8. The Secretary, Nyishi Service Engineers Forum, (NSEF)
  9. The President, Nyishi Agri-Allied Extension Society (NAAES).
  10. The General Secretary, Nyishi Agri-Allied Extension Society (NAAES).
  11. Any other sister organizations/ societies of the Nyishi community.

 

ARTICLE 16: NYISHI ELITE SOCIETY, DISTRICT UNIT.

            There shall be District Unit of Nyishi Elite Society in all Nyishi dominated districts including Assam or elsewhere comprising of following portfolios:-

  1. The Chairman
  2. Vice- Chairman
  3. Convenor
  4. Co-Convenor
  5. Treasurer

 

ARTICLE 17: AMENDMENT OF THE BYE-LAW

Under this article of the Bye-Law, which is the specific provision to deal with amendments of the Bye-Law; the General Conference is the repository of the constituent power to amend the Bye-Law of the Society. Procedures and Rules for any amendments are as under:

  1. proposal for addition to or alteration in and deletion of the Bye-Law shall be addressed to the President at least two months before the General Conference of the Society;
  2. such amendments shall be circulated among the members of the Executive Body by the Secretary at least one month before the General Conference;
  3. the Executive Body shall consider the proposed amendments and make such recommendations to the Society, as it may deem desirable, and shall place them at the biannual Business Session of the Society; and
  4. two-third majority of the members present and voting at the General Body Meeting shall amend the Bye-Law.

 

ARTICLE 18:  AWARDS AND CITATIONS

i.           The Nyishi Elite Society shall institute three Awards along with Citations to honour and recognise the outstanding contributions made by and dedicated to the upliftment in  the field of academic, arts, culture, literature, statesmanship, science & technology of the Nyishi Community.

ii.          In pursuance of the above awards and citations, the Society shall constitute a panel of Jury for the purpose.

 

ARTICLE 19: LANGUAGE

The Nyishi to be the official language for conducting business in the meeting and the session, is mandatory.

 

ARTICLE 20:  WINDING UP

            The Society shall not be wound up except by resolution to that effect passed by three-fourths of the members in a General Body Meeting duly convened for the purpose. It upon the winding up of the Society, there shall remain after the satisfaction of its debts and liabilities any property whatsoever, the same shall not be paid to be distributed among the members of the Society but shall be given to some other   Society with similar objectives to be determined by not less than three-fifths of the members present and voting.

 

THE FIRST SCHEDULE

  1. The word ‘NISHING’ has been omitted and replaced by the word ‘NYISHI’ as Resolution adopted in the 5th General Conference held at Daporijo from 18th to 21st December 1999, Upper Subansiri district, Arunachal Pradesh[See Article 4].
  1. In the original Bye-Law of the Society the Preamble was not embodied which was submitted to the Government for the registration of the Society. However, the Preamble to the Bye-Law is added here in this amended Bye-Law based on the aims and objectives which the Society strives to achieve [See Page 3].
  1. The Headquarters of the Society has been changed and shifted from Itanagar to Nirubjully due to establishment of permanent office premises at Nyikum Nyia Hall, Nirubjully, under Naharlagun Administrative Centre, District Papum Pare, Arunachal Pradesh [See Article 1].
  1. The aims and objectives of the Society have been suitably amended in order to reflect the contemporary changing pace of the society [See Article 3].
  2. Article on ‘Definition’ is added to define the various working terminologies or words/terms and compound meaning of the Society [See Article 4].
